Dog Surrender Terms & ConditionsBy signing this agreement, the surrendering party (“Owner”) acknowledges and agrees to the following legally binding terms:1. Voluntary Surrender and Transfer of OwnershipThe Owner voluntarily and irrevocably surrenders all rights, title, and interest in the dog to SEQ K9 Rescue Inc. (“the Rescue”).Ownership of the dog transfers in full and permanently to the Rescue upon execution of this agreement and physical acceptance of the dog into the Rescue’s care.The Owner warrants that they are the legal owner of the dog or are duly authorised to surrender the dog on behalf of the legal owner.2. Finality of SurrenderThis surrender is final and unconditional.The Owner expressly acknowledges that they relinquish all present and future rights to reclaim, recover, or otherwise assert ownership or control over the dog once surrender is completed.3. Behavioural and Medical DisclosureThe Owner warrants that all information provided to the Rescue regarding the dog is complete, accurate, and not misleading, including but not limited to:• Medical history and conditions• Behavioural history and temperament• Aggression or bite incidents• Anxiety or behavioural disorders• Vaccination status• Worming and parasite prevention• Current or past medications• Previous ownership historyThe Owner acknowledges that failure to disclose relevant information may impact the safety, welfare, and management of the dog, other animals, and persons in the Rescue’s care.4. Veterinary Care, Desexing, Microchipping, and VaccinationUpon intake, the Rescue is authorised to provide or arrange any veterinary treatment deemed necessary for the dog’s health and welfare, including but not limited to:• Veterinary examination and treatment• Desexing (if not already completed or if status is unknown)• Microchipping (MC) or updating of existing microchip details• Vaccination (including core and booster vaccinations)• Parasite prevention and treatment• Emergency veterinary care• Diagnostic testing and procedures• Dental or surgical procedures as requiredThe Owner acknowledges that all veterinary decisions, including timing and necessity, are at the sole discretion of the Rescue and attending veterinary professionals.5. Safety and Aggression ManagementIf the dog exhibits aggressive, dangerous, or high-risk behaviour while in the care of the Rescue, the Rescue will make reasonable efforts to contact the Owner.The Owner may be offered the opportunity to collect the dog, subject to the Rescue’s sole determination that such release is safe, lawful, and appropriate.If the Owner is unwilling or unable to collect the dog, or if release is not deemed safe or appropriate, the Rescue shall retain full discretion to manage the dog in accordance with its duty of care, including all necessary welfare and safety decisions.6. Sole Discretion for Assessment and OutcomeThe Rescue retains sole and absolute discretion to assess the dog and determine its suitability for rehabilitation, foster placement, transfer, or rehoming.The Rescue may, at its discretion:• Place the dog into foster care• Transfer the dog to another rescue organisation• Retain the dog for behavioural or medical rehabilitation• Determine an appropriate permanent placement• Arrange humane euthanasia where required for welfare, behavioural risk, or public safety reasonsThe Owner acknowledges that rehoming is not guaranteed, particularly where the dog is assessed as aggressive, dangerous, or unsuitable for safe placement.7. No Guarantee of RehomingThe Owner acknowledges that rehoming is not guaranteed.Each dog is individually assessed based on health, behaviour, temperament, and overall welfare considerations, and outcomes are determined solely by the Rescue.8. Financial TermsThe Owner acknowledges that surrendering a dog does not create any obligation on the Rescue to provide financial compensation, updates, or return services.Any voluntary surrender donation is non-refundable.9. Media and Promotional UseThe Owner grants the Rescue an irrevocable licence to photograph, film, and use images or recordings of the dog for operational, educational, promotional, and fundraising purposes, including adoption marketing.10. Privacy and Personal InformationThe Owner’s personal information will be collected, stored, and used in accordance with applicable Australian privacy laws and will only be used for legitimate rescue administration purposes unless otherwise required by law.11. Limitation of Liability and IndemnityTo the fullest extent permitted by law, the Owner releases and indemnifies SEQ K9 Rescue Inc., its committee members, volunteers, foster carers, and associated veterinarians from any liability arising from decisions made regarding the dog’s care, handling, rehabilitation, placement, transfer, or euthanasia following surrender.12. Microchip and Registration TransferWhere applicable, the Owner authorises the immediate transfer of the dog’s microchip (MC) registration into the name of SEQ K9 Rescue Inc. or its nominee.The Owner acknowledges that this transfer reflects and supports the permanent transfer of ownership under this agreement.
13. Finality of Surrender
By signing this agreement, the Owner permanently and unconditionally surrenders the dog to SEQ K9 Rescue Inc.
The Owner confirms they are the lawful owner, or have legal authority to surrender the dog, and relinquishes all present and future rights to reclaim or exercise ownership or control over the dog.
Behavioural & Medical Disclosure
The Owner confirms all information provided about the dog is complete and accurate, including:
* Medical history and medications
* Behaviour, temperament, anxiety, aggression or bite history
* Vaccination, worming and parasite prevention
* Previous ownership and other relevant history
Failure to disclose relevant information may place the dog, other animals or people at risk.
Veterinary Care
All veterinary decisions will be made by the Rescue in consultation with attending veterinary professionals.
Behaviour, Safety & Welfare
The Rescue will assess the dog’s health, behaviour, temperament and suitability for rehabilitation and rehoming.
SEQ K9 Rescue Inc. may provide foster care, medical or behavioural rehabilitation, transfer the dog to another rescue, or arrange an appropriate permanent home.
Where a dog displays serious aggression, dangerous behaviour, significant medical concerns or cannot safely or humanely be rehomed, the Rescue may make any necessary welfare and safety decisions, including humane euthanasia where appropriate.
Where practicable, the former Owner may be contacted; however, this does not create any right to reclaim the dog. Any return is entirely at the discretion of SEQ K9 Rescue Inc.
Rehoming is not guaranteed.
Surrender Fee
A $50 surrender fee is payable at the time of surrender.
The surrender fee assists with the initial costs associated with taking the dog into care and is non-refundable once the surrender has been completed.
Microchip & Registration
The Owner authorises the immediate transfer or updating of the dog’s microchip and registration details into the name of SEQ K9 Rescue Inc. or its nominee.
Privacy
Personal information will be handled in accordance with applicable Australian privacy laws and used for legitimate rescue administration or where otherwise required by law.
Release & Indemnity
To the extent permitted by law, the Owner releases and indemnifies SEQ K9 Rescue Inc., its committee members, volunteers, foster carers and associated veterinary professionals from claims arising from decisions reasonably made regarding the dog’s care, treatment, behaviour management, placement, transfer, rehoming or humane euthanasia following surrender.
By signing, the Owner confirms they understand and accept that the surrender is permanent and ownership of the dog transfers to SEQ K9 Rescue Inc.
